Article 1 – Definitions
In these terms and conditions:
holiday accommodation: the accommodation made available;
Delvers Duinhuis: Mrs L. Grün-Ranzijn and/or Mr K. Grün;
holiday maker: the person who enters into the agreement regarding the holiday accommodation with Delvers Duinhuis;
fellow holiday maker: the person(s) also specified on the agreement;
third: any other person, not being the holiday maker and/or his fellow holiday maker(s);
agreed price: the fee paid for the use of the holiday accommodation;
costs: all costs for Delvers Duinhuis associated with making the holiday accommodation available;
information: written/electronic data about the use of the holiday accommodation, the facilities and the rules regarding the stay;
cancellation: the written termination of the agreement by the holiday maker before the commencement date of the stay;
a dispute: if a complaint from the holiday maker submitted to Delvers Duinhuis has not been resolved to the satisfaction of the parties.
Article 2 – Content agreement
For recreational purposes, so not for permanent residence, Delvers Duinhuis makes available to the holiday maker a holiday accommodation of the kind or type that has been agreed, for the agreed period and the agreed price.
Delvers Duinhuis is obliged to provide the holiday maker with the written information on the basis of which this agreement is also concluded in advance. Delvers Duinhuis always informs the holiday maker of changes in writing in good time.
If the information deviates significantly from the information provided when entering into the agreement, the holiday maker has the right to cancel the agreement free of charge.
The holiday maker is obliged to comply with the agreement and the associated information. He ensures that fellow holiday maker(s) and/or third parties who visit him and/or stay with him comply with the agreement and the associated information.
Smoking and pets are not allowed in the holiday accommodation. It is not allowed to make fire in and outside the holiday accommodation, except in the designated fireplaces.
Article 3 – Duration and expiration of the agreement
The agreement ends by operation of law after the expiry of the agreed period, without notice being required.
Article 4 – Price and price change
The price is agreed on the basis of the rates applicable at that time, which have been determined by Delvers Duinhuis.
If after determination of the agreed price, due to an increase in the burden on Delvers Duinhuis, additional costs arise as a result of a change in charges and/or levies that directly relate to the holiday accommodation or the holiday maker, these can be passed on to the holiday maker , even after the conclusion of the agreement.
Article 5 – Payment
The holiday maker must make payments in euros, unless agreed otherwise, with due observance of the agreed terms.
If the holiday maker, despite prior written notice, does not or not properly fulfill his payment obligation within a period of two weeks after the written notice, Delvers Duinhuis has the right to terminate the agreement with immediate effect, without prejudice to Delvers Duinhuis's right to full payment of the agreed price.
If Delvers Duinhuis is not in possession of the total amount due on the day of arrival, it is entitled to deny the holiday maker access to the holiday accommodation, without prejudice to Delvers Duinhuis's right to full payment of the agreed price.
All extrajudicial costs reasonably incurred by Delvers Duinhuis, after a notice of default, are at the expense of the holiday maker. If the total amount is not paid on time, the statutory interest rate on the outstanding amount will be charged after written demand.
Article 6 – Cancellation
In case of cancellation more than 60 days before the commencement date, no cancellation fee is due.
In the event of a cancellation from 60 to 30 days before the commencement date, a cancellation fee of 50% of the agreed price is due.
In case of cancellation from 30 days or less before the commencement date, a cancellation fee of 100% of the agreed price is due.
Article 7 – Use by third parties
Use of the holiday accommodation by third parties is only permitted if Delvers Duinhuis has given written permission for this.
Conditions may be imposed on the consent given.
Article 8 – Stay in the holiday home
The following stay periods and times apply to reservations/stays, namely:
• Weekend: Friday from 4:00 pm to Monday 10:00 am;
• Midweek: Monday from 4:00 pm to Friday 10:00 am;
• Week: Friday from 4:00 pm to Monday 10:00 am.
The tenant and other users must behave as a good tenant during their stay in and around the house
The holiday home is non-smoking. Smoking is allowed outside on the terrace.
Bringing pets is not allowed, unless otherwise agreed with Delvers Duinhuis.
Although the use of water and electricity is included, we kindly ask you to use this sparingly.
Moving cupboards and beds, as well as sound or television equipment or taking any part of the (indoor) inventory outside is expressly not permitted, with the exception of the crockery/glasses and cutlery for your meal outside.
Article 9 – Early departure of the holiday maker
In the event of an early departure of the holiday maker, the holiday maker still owes the full price for the agreed rate period.
Article 10 – Premature termination by Delvers Duinhuis and eviction
Delvers Duinhuis can terminate the agreement with immediate effect:
If the holiday maker, fellow holiday maker(s) and/or third party(ies) does not or does not properly comply with the obligations under the agreement, the associated information and/or government regulations, despite an earlier warning, and does so to such an extent that, according to the standards of reasonableness and fairness, Delvers Duinhuis cannot be required to continue the agreement;
If, despite an earlier warning, the holiday maker causes a nuisance or spoils the good atmosphere on or in the immediate vicinity of the site;
If, despite a previous warning, the holiday maker acts contrary to the destination of the site by using the holiday accommodation.
If Delvers Duinhuis wishes premature termination and evacuation, he will let the holiday maker know. A warning as referred to in the first paragraph of this article may be omitted in urgent cases.
After cancellation, the holiday maker must ensure that the holiday accommodation is vacated and the site is left as soon as possible, but no later than four hours after Delvers Duinhuis's request to do so.
The holiday maker remains obliged to pay the agreed rate.
Article 11 – Laws and regulations
The holiday maker is obliged to strictly comply with all safety regulations applicable on the site. He also ensures that fellow holiday maker(s) and/or third parties who visit him and/or stay with him strictly comply with the safety regulations applicable on the site.
Article 12 – Maintenance and construction
Delvers Duinhuis is not liable for loss/theft of or damage to goods when Delvers Duinhuis has not caused this itself or cannot be blamed for this, nor is Delvers Duinhuis liable for consequential damage, including loss of income, loss of profit and damage as a result of delay.
Insofar as Delvers Duinhuis is liable, this is in all cases limited to a maximum of € 10,000 per event, unless there is intent or deliberate recklessness on the part of Delvers Duinhuis.
Delvers Duinhuis is not liable for the consequences of extreme weather conditions or other forms of force majeure.
The holiday maker is liable towards Delvers Duinhuis for damage caused by the acts or omissions of himself, the fellow holiday maker(s) and/or third parties, insofar as it concerns damage to the holiday maker, the fellow holiday maker(s). and) and/or third party(s) can be attributed.
Article 13 – Law
Only Dutch law applies to all our terms and conditions from the rental agreement / house rules, as well as any disputes arising from this.
